RESULT: Dismissed Broward County Judge Dismisses DUI Case According to a Broward Sheriff's Office Deputy, at 10 pm the driver was traveling east on Sunrise Blvd with his lights turned off. The driver made a wide turn to go north on Federal Highway, over-corrected and nearly struck the concrete divider. The BSO Deputy turned on his lights and siren to stop the driver, however, the driver did not react. The driver finally stopped after the deputy activated his air horn. According to the deputy, the driver emitted a strong odor of alcohol, his face was flushed, he had difficulty maintaining his balance while standing, and his eyes were red and watery. The driver presented a yellow repair bill when the deputy asked for his driver license and proof of insurance. The driver failed the HGN, Walk-and-Turn and One Leg Stand test. He was arrested, handcuffed and transported for further DUI testing. At the station, the driver agreed to provide a breath sample by blowing into the Intoxilyzer 8000. The driver's blood alcohol content (BAC) registered a .231% and his second reading registered a .225%. The driver met with and retained a Miami DUI lawyer at DMT. Our Miami DUI attorney immediately began preparing and defending the case. After thoroughly investigating the case, we filed multiple motions. The judge granted our motion to compel the State of Florida to provide additional discovery. The judge also charged the State of Florida with delaying the case. With these rulings, our Miami DUI lawyers were able to win the case on a speedy trial basis. Ultimately, all of the charges were completely dismissed against the driver.
RESULT: Found Not Guilty Atlanta Woman Charged with Simple Battery Wins at Trial A woman was charged in Miami for defending herself from an aggressive panhandler in front of the Miami State Attorney's Office. Our client exited her vehicle after being struck by an alleged ex-U.S. military serviceman. Our Miami criminal attorneys were able to prove that the alleged victim was not a veteran and convinced a Miami jury that our client committed the battery in self-defense. In less than 10 minutes, the Miami jury agreed with the Miami criminal lawyer from DMT and our client went back to Atlanta with an acquittal.
RESULT: Charges Dropped Prosecutor Drops Cocaine and Marijuana Sale Charges Punishable By 15 Year Prison Sentence to Misdemeanors Members of Miami-Dade Police Department's drug enforcement team arrested a man following a drug investigation. The police claimed he sold marijuana and cocaine to numerous individuals over the course of surveillance. At the conclusion of the investigation, the police arrested the man for sale of cocaine, sale of marijuana, and possession of marijuana. The State Attorney charged the man with two felony charges for sale of drugs, each charge punishable by fifteen years in state prison. Following a complete investigation by a DMT, motions to suppress the evidence were filed. Although the police and the assistant state attorney initially claimed to have a strong case, the prosecutor dropped both of the felony drug charges immediately following jury selection.
RESULT: Dismissed Judge Dismisses Injunction Against Domestic Violence And State Dismisses Battery Charge A Miami-Dade County resident retained DMT to defend an injunction against domestic violence and a domestic violence battery charge. The legal team at DMT obtained the surveillance video from the home to refute the allegations made by the client's wife and two of her children. Additionally, DMT obtained the 911 transmission tapes which bolstered the credibility of our client. The wife accused our client of striking her in the face with a closed fist. With the assistance of the video, the 911 transmissions, and the testimony of our client's daughter, the domestic violence judge dismissed the injunction after a three hour hearing on the matter. The criminal defense lawyers at DMT obtained the transcript of the hearing and presented it to the county prosecutor handling the misdemeanor battery case. After several meetings, the prosecutor questioned the veracity of the victim and her witnesses and dismissed all of the charges pending against our client. Through our aggressive approach to the case, our attorneys convinced the judge and the state that our client acted in self-defense resulting in the dismissal of both cases.
RESULT: Charges Dropped Prosecutor Decides to Drop Miami Mortgage Fraud Charges The Miami-Dade Police Department's Mortgage Fraud Task Force arrested a woman for Grand Theft in the First Degree and Uttering a Forged Deed. The mortgage fraud defense team at DMT were retained after the police made the decision to arrest her. Our firm immediately commenced work on the case and managed to get her out jail in less than 3 hours. Our lawyers and staff then investigated the case and presented our findings to the prosecuting attorney. Following the meeting with our lawyers, the assistant state attorney decided to drop all charges against our client. Because of the immediate response of DMT, the client is able to have her record expunged.
